TM44 Regulations – Everything You Need To Know
Once you have bought an air conditioning system and had it installed, it is easy to push it to the back of your mind while you focus on other aspects of your life and business. However, keeping your system checked and maintained is essential for both safety and compliance. A TM44 inspection forms part of this ongoing process, ensuring you remain within the law.
What Is A TM44 Air Conditioning Inspection?
First introduced in 2011 under the Energy Performance of Buildings Directive (EPBD), the TM44 inspection is the process by which an accredited assessor visits your premises to inspect your air conditioning system. During the inspection, the assessor reviews the efficiency of your system, checks for faults, and advises on how to make it more efficient, sustainable and cost-effective to run. Following the inspection, you receive a full report detailing findings, faults and recommendations.
Who Requires A TM44 Air Conditioning Inspection?
Building owners and managers in England and Wales who control air conditioning systems with an effective rated output of more than 12kW must comply with the regulations. This includes systems made up of individual units below 12kW whose combined effective rated output exceeds 12kW.
The requirement applies to both commercial and residential properties. It is the responsibility of the property owner to arrange the inspection, which must take place every five years to maintain compliance.
What Happens If I Don't Have a TM44 Air Conditioning Inspection?
If you have an air conditioning system of at least 12kW and have not had an inspection within the last five years, you are breaking the law and risk receiving a penalty. These penalties can be severe. The maximum current penalty ranges from £300 to £5,000. A fine of £300 per building/offence is typically issued for not having a valid TM44 certificate. Trading Standards can issue an additional £200 fine if you fail to produce the report within seven days of a request. For non-compliance or failure to act on notices, fines can reach £5,000. Some reports indicate that if the breach is ongoing, penalties can be repeated, or in extreme cases, reach higher amounts.
